Biography
Mr. Van Dusen advises clients in litigation and alternative dispute resolution matters, primarily in the areas of commercial, insurance and personal injury defense including arbitration hearings, bench trials, jury trials and appeals. His diverse litigation experience includes:
- Complex commercial cases, including breach of contract, supplier disputes, claims related to the purchase or sale of businesses, distributor termination disputes, and claims related to partnership dissolution and shareholder valuation.
- The defense of lender liability claims, including common law fraud claims and claims under the Equal Credit Opportunity Act.
- Representation of lenders in claims involving security interest priority disputes and the enforcement of rights under loan documents.
- Representation of insurers in defense of claims for recovery of insurance benefits, including claims for life and disability insurance benefits and ERISA claims.
- Representation of owners and contractors in construction disputes involving major projects, including One Detroit Center, the University of Michigan Hospital, DaimlerChrysler U.S headquarters, and the Pope John Paul II Cultural Center.
- The defense of catastrophic personal injury claims, including matters involving product liability, premises liability, automobile negligence and intentional misconduct claims.
