Ms. O’Reilly is a member of the Health Care Practice Group and the Litigation and Alternative Dispute Resolution Practice Group. Ms. O’Reilly’s practice focuses on meeting all needs of health care industry clients, including hospitals, medical centers, physician groups, laboratories, insurers, and employer provided health and welfare benefit plans. Ms. O’Reilly has experience counseling clients on Stark Act and Anti-Kickback compliance, HIPAA compliance, certificate of need review, licensing issues, staff management issues, and health care anti-trust issues.
Ms. O’Reilly’s litigation practice focuses largely on defending ERISA civil enforcement actions brought against employer plan sponsors, insurers, plan administrators, hospitals, and other fiduciaries. Ms. O’Reilly specializes in handling defense of claims of systematic breaches of fiduciary duty. As such claims are often plead as class claims, Ms. O’Reilly has extensive experience with large class action litigation.
Ms. O’Reilly’s ERISA experience also includes designing and managing pension and welfare benefit plans, overseeing HIPAA compliance, advising employers and boards of directors on fiduciary issues, and resolving benefit plan issues in corporate transactions. She has been recognized as a scholar in the area of ERISA preemption.
Ms. O’Reilly also handles a variety of other civil litigation matters related to the needs of health care industry clients. For example, she was part of the Bodman team that successfully represented the Detroit Medical Center in obtaining an injunction to prevent the Karmanos Cancer Center from moving to a location off the DMC’s main campus.
Before joining Bodman, Ms. O’Reilly served as a law clerk to the Honorable John D. Rainey of the United States District Court for the Southern District of Texas. Before her clerkship, she practiced employee benefits law with a firm in Washington, D.C. In law school, Ms. O’Reilly served as the executive symposium editor for the Notre Dame Law Review.
